Some thoughts on Copyright

Today I started learning my way around the imeem web site. It looks great and I love being able to just start a playlist and listen to my favorite music. But I'm a bit confused about the whole content side of things.

There are endless copies of what I consider copyrighted material from well known musicians that have been uploaded by fans who certainly love the music they are posting. Yet is this not a violation of the terms of use?

From imeem's own Terms Of Use:

"You must not upload or present any media or content in which you do not have the appropriate rights to do so. You may be in violation of copyright laws if you do not have the appropriate rights to the media or content you upload or present on imeem. imeem will not tolerate known infringements or misbehavior by its users. It is imeem's policy to terminate the accounts of known repeat infringers. In addition, unauthorized copying, distribution, modification, public display, or public performance of copyrighted works may be an infringement of the copyright holders' rights. You may not copy, reproduce, distribute, or create derivative works without being authorized to do so by law or by the copyright holder."

And yet here in the terms of use I seem to be signing away my rights to any content that is MY OWN and that I do upload to the imeem site:

"To the extent that imeem provides you with an opportunity to post, store and exchange Member Content, you agree to and hereby do grant, and you represent and warrant that you have the right to grant, imeem, its contractors, and the users of the imeem Site an irrevocable, perpetual, non-exclusive, royalty-free, fully sublicensable, fully paid up, worldwide license to use, copy, publicly perform, digitally perform, publicly display, and distribute such content and to prepare derivative works of, or incorporate into other works, such Member Content on the imeem Site or Service."

So what's the story? Shouldn't all of this great music only be uploaded by the actual musicians? If I buy a CD and upload a copy of the song to imeem am I violating copyright laws or imeem's Terms of Use? Many may consider these dumb questions, and I have my own answers, but I'd like to know what others think.
